Pi-Dan Website Terms of Use
PI-DAN INGENUITY LLC (Florida document L18000004534) is the contracting party.
English is the controlling language of these Terms.
Acceptance and scope
These Terms govern access to Pi-Dan websites and services operated by PI-DAN INGENUITY LLC. Using an interactive service means you agree to these Terms, any applicable supplement, and the Privacy Policy.
Eligibility
Passive pages may be viewed globally. Interactive services are offered only to people in the United States who are at least 18.
Versions and changes
Pi-Dan may update these Terms. Continued interactive use after notice of a material change means you accept the updated Terms.
Accounts and security
You are responsible for use of your account. Pi-Dan may suspend access to protect the service. Account features are not currently available.
Acceptable use
Do not break the law, abuse the service, bypass security or eligibility controls, scrape contrary to published limits, impersonate others, or interfere with operation.
Intellectual property
Pi-Dan and its licensors keep their rights in the site and its content. You receive a limited personal license to use the service. No ownership transfers.
Third-party services
Third-party services are under their own terms. Pi-Dan is not responsible for those services except as the law requires.
Suspension and termination
Pi-Dan may suspend or end interactive access. You may stop using the service.
Service disclaimers
To the maximum extent permitted by law, the service is provided as available, without promises of uninterrupted, error-free, or secure operation.
Limitation of liability
To the maximum extent permitted by law, Pi-Dan's aggregate liability arising from an affected service is limited to the greater of USD 50 or the fees you paid for that affected service during the six months before the claim. This limit does not apply where the law does not allow it.
Indemnity
To the extent permitted by law, you will indemnify Pi-Dan against third-party claims arising from your unlawful use or material breach of these Terms.
Arbitration
You and Pi-Dan agree to resolve disputes arising out of these Terms or the service by binding individual arbitration under the Federal Arbitration Act and the AAA Consumer Arbitration Rules. Class, collective, and representative actions are waived. Either party may instead bring an individual claim in small-claims court. The limitation of liability in these Terms applies in arbitration. Pi-Dan may go to court to protect its intellectual property. If the class waiver cannot be enforced, it is severed and the rest of this arbitration agreement remains. You may opt out of arbitration by emailing legal@pi-dan.com within 30 days after you first agree to these Terms.
Governing law and venue
Florida law governs these Terms, except that the Federal Arbitration Act governs the arbitration agreement. Courts in Broward County, Florida, or the United States District Court for the Southern District of Florida may hear a small-claims case or a proceeding to enforce the arbitration agreement.

General provisions
If a provision cannot be enforced, the rest still applies. Failure to enforce is not a waiver. These Terms and any applicable supplement are the entire agreement for the service. The supplement controls a direct conflict.
